This department only handles permits needed within the City limits of Fayetteville. If you are in another jurisdiction, you must contact them for their rules and regulations.
Be sure to follow your approved plans, whether they are drawn by an architect or designer or are standard construction requirements given to you by the city. If you change the plans while building the structure, this will cause problems when the project is inspected. If you do decide to make changes, check with the city's plan review staff or your field inspector.
Home owners are allowed to obtain permits on the residence in which they currently reside. However, if an unlicensed contractor asks you to pull a building permit as property owner for a project, you are, in fact, becoming a contractor and may be helping the unlicensed contractor evade state licensing laws. You may be jeopardizing legal protections in the law designed to protect you as a consumer. If a contractor asks you to pull a homeowner's permit in lieu of the contractor obtaining the building permit themselves, we recommend you consult your legal advisor.
Permit issuance periods vary. Some projects can be fully permitted over-the-counter, meaning a return trip won't be needed. Some projects, however, require that plans be left for additional review.

The city recommends that you deal only with a contractor licensed by the State of Georgia. The Contractors' Licensing Board's telephone number is 478-207-2440.
It is your responsibility to call us for inspections at specific times during construction. You may have your contractor make the call, but it is still your responsibility, as the property owner, to make sure the inspections are made. Inspections are made during certain points in the project, depending on the work that's being performed. For example, decks require inspections of the footing, framing/attachment to house and when all work is finished.
Remember, the project is not complete for legal purposes until it has passed the final inspection.
Zoning sets up, within a defined area, the types of buildings and what they will be used for. For example, a residential area may be zoned R22, which means that the lots can contain one single-family home and the lots are a minimum of 22,500 square feet.
Zoning is regulated based on maps approved by the City Council. A variance may be obtained in some cases if a property owner wants to build something not allowed in the property's zone.
Some questions and approvals for zoning can be issued over-the-counter by the same staff that reviews your building plans. Others need reviews by specialty zoning or planning staff.

Permits are the way the city of Fayetteville regulates construction. This is designed to ensure that all construction in the city is safe. The safety of the occupants of buildings is the primary reason for having construction codes. The City of Fayetteville has adopted several codes, among them the International Building, Mechanical and Plumbing, and National Electrical codes. In addition, there are federal, state and local laws that govern construction, such as those covering energy conservation.
There are several different types of permits, based on the type of construction: structural, plumbing, mechanical and electrical (used for single-family home construction and other small projects). In addition, the complete demolition and relocation of buildings also requires permits.
Obtaining the permit is just the first step in the process. In this step, you may need to create plans to submit to the department, make a plot plan for your property showing the improvements, and show the type of construction you'll be using.
Once plans are approved, you're required to build the project to those plans. If any changes are made to the plans, they must be made with the city's approval.
The second half of the process is the inspection of the work. More about that later.
If a permit, when needed, is not obtained before construction, you have violated city codes and regulations; you'll be subject to fines and penalties. You'll be required to obtain permits for the work and it must pass inspection, or you'll have to return the structure or site to its original condition.
Remember, construction codes were created for safety reasons. Work built without a permit can be unsafe, no matter how good it looks.

Permits expire after 180 days if no inspections have been made. In order for the project to be complete, it must pass final inspection. If a permit expires before final inspection, the project is in violation of city codes. If this is your case, call 770-719-4062. A construction permit is needed for all new construction, remodeling and repairs. A plumbing, electrical or mechanical permit maybe needed for any addition or changes to a building's existing system; for example, moving or adding an electrical outlet requires a permit.

For plumbing, mechanical and electrical work, replacement or repair of fixtures (such as changing water faucets or replacing switches) does not normally require a permit. Replacing a water heater or adding a permanently wired light fixture does, however, require a permit.

Plans for projects such as room additions can usually be drawn up by qualified individuals such as architects or engineers licensed by the State of Georgia.

If you will be hiring anyone, you may have to purchase Workers' Compensation Insurance, which is available from a variety of agencies. If you won't be hiring anyone, we'll ask you to sign an "Owner-Builder Statement" to this effect. We can't issue you a permit without either insurance or the completed Owner-Builder Statement.

To be eligible for the office of Mayor or City Council, a person must be at least 21 years of age, must meet the requirements of a qualified elector for members of the General Assembly as prescribed by state law, must be a registered voter in the City of Fayetteville and must be a bona fide resident of the City of Fayetteville for 1 year preceding the time of the holding of the election in which that person is a candidate. No person shall be eligible to serve as a Mayor or City Council member who shall have been convicted of a crime involving moral turpitude unless such person has received a full pardon and has all rights of citizenship restored.

The fee is $396 for the Mayor Position and $288 for the Council Positions. This is 3% of the annual salaries for these positions and is the minimum amount required by State law.

The Georgia Department of Transportation owns, maintains, and controls the timing of most traffic signals in Fayetteville. Two traffic signals on Jimmie Mayfield Boulevard and third traffic signal on North Jeff Davis are owned and maintained by the City. 770-461-4548 is the non-emergency phone number that can be used during normal business hours (Monday through Friday, 8 am to 5 pm). This number is used for general requests for information. Occasionally, we will receive phone calls on our non-emergency number for situations that require our assistance, but the caller is reluctant to call 911 and report it as an emergency.
If you encounter a situation that concerns you enough to contact the fire department, please go ahead and call 911 instead of the non-emergency fire department number. This will ensure the proper personnel, apparatus, and equipment are dispatched to your location.
We welcome our citizens to drop by the fire station for a visit. We are happy to conduct a tour of the station and apparatus, as well as answer any questions. Scheduling of such visits are not required but recommended.
We do ask that groups desiring to participate in a tour call ahead and schedule this through the Fire Marshal’s office at 770-719-4054. This will ensure that we have personnel available to receive the group and conduct a quality tour.

Occasionally someone may call and complain about a controlled burn. A fire apparatus will respond to investigate any complaints. We may or may not ask the homeowner to extinguish the fire, depending on the situation we discover.
If you live within the City limits, just call the Fire Department at 770-461-4548 and notify us that you intend on burning. We do not issue permits, but request notification to ensure that we are able to review the rules for outdoor controlled burning. We will occasionally deny a request to conduct a controlled burn, based on prevailing weather conditions. Commercial burn permits, for projects such as land clearing, must be obtained through the Fire Marshal’s office.

Most citations can be paid prior to the court date, indicated near the bottom of the citation without having to appear in court. Failure to appear in court or failure to pay a fine before the court date will result in a license suspension and/or a warrant being issued for the violator’s arrest.
Failure to Appear - Effective July 1, 2017, per Georgia Senate Bill 176, the Defendant will have 30 days from missed court date to dispose of citation. If a defendant’s citation is not disposed of within 30 days from missed court date, a bench warrant and/or license suspension will be issued. A contempt fee of $100 will be assessed.

If payment is not received before your court date, you are required to appear in Court on the date shown on the traffic citation.
Failure to Appear - Failing to pay your fine and/or appear in court, will result in a suspension of your license, and/or warrant may be issued. A Failure to Appear fee will also be assessed.
Your driver’s license, if taken, will not be returned when payment is received by the Clerk’s office.

If you would like to have a Jury Trial in the State Court of Fayette County, you may also request your case to be bound over in front of the Judge on your scheduled court date. Also, you may complete a defendant's request for Jury Trial form in person during normal business hours (ID required) prior to your court date.
Your signature on the bottom of the citation is not an admission of guilt. It means that you acknowledge having received a copy of the citation and that you will either pay the fine or appear in court on the date indicated. If you refuse to sign the citation you are subject to being arrested and having to post a bond until your case is heard in court.
Our court solicitor may take completion of defensive driving into consideration when a defendant has taken a course and brings the certificate to the court. Very seldom is a fine amount reduced or dismissed, however, it is up to the court solicitor based on the facts of each case.
Under Georgia law, an officer is not required to show the defendant the speed detection device. When dealing with radar speed enforcement specifically, the officer is required by law to ask if you would like for a calibration check of the unit. That check is done by the use of calibrated tuning forks which is used to verify that the counter unit in the device is operating properly.
If requested, the officer is obligated by law to perform that calibration check and inform the defendant of the results. The offender is not entitled to witness this check nor are they entitled to see the radar display. This does not apply to LIDAR (Laser) speed detection devices because the calibration checks for these units cannot be performed roadside.

Property owners are responsible for driveways and driveway culverts, even in the road right-of-way. The City is responsible to maintain the drainage along the road, but allows adjacent property owners to cross the road with their driveways and culverts.
The City Public Works Department maintains shoulders along major roads. Normally, in subdivisions, the homeowner maintains the shoulder.
In general, creeks are part of the adjacent property and should be cleared of debris and blockages by the property owners. The City does not own the creeks, but we occasionally have a project that affects a creek, such as a flood control project, and we occasionally perform emergency work in creeks. The basic charge is $4.37 per equivalent residential unit (ERU), which equals 3,800 square feet of impervious surface (rooftops, pavement and similar hard surfaces that water cannot penetrate). Each residential unit pays $4.37 per month. Non-residential property pays $4.37 per ERU. This amount was determined by a formula considering the cost of the stormwater program and the number of ERUs in the City. The fee is only charged to property inside the City Limits.
The stormwater fee is used to pay for capital projects to relieve flooding, for increased inspection of drainage facilities, for increased maintenance of the City's stormwater system, and to meet the state regulatory requirements.

A water meter can be defective. A water meter has an internal disc or paddles that move when water passes through them which in turn moves the wheels on the register to record the water that passes through it. When the disc or paddles wear down due to environment or from a defect inside of the meter it will not register correctly. Since we use meters that record only the water that passes through it the defect will actually cause a lower water bill. A water meter will never turn unless water is passed through it to record.
The Water Department is responsible for the water main, the line that goes to the meter, the meter and meter box. The service line, which starts at the meter and goes to the house, is the customer's responsibility, even if the leak is in the meter box but is on the service line. If you have a leak on the service line you will have to contact a plumber for repairs.
Service lines are made of different materials ranging from plastic to copper to galvanized. The technology for leak detection on a service line is very expensive and not very effective. Some plumbers do have the resources available to locate leaks in slabs or in basements but the technology has not been proven effective in locating leaks in a yard. The technology requires its placement to be on a concrete surface.
The City of Fayetteville obtains water from two different sources. Approximately fifty % of the water is supplied by two deep water wells, and the remaining water supply is provided via the Fayette County Water System.
If you have a problem with a sewer back-up you can call our Finance Billing Office 770-460-4237 Monday through Friday from 8 am until 5 pm and they will radio our Distribution Crew for the quickest response. Call the Water Department 770-460-4660 first in order for us to assess the problem to see if a plumber would have to be called. A sewer jet machine will be used to get the sewer flowing freely again. If the problem is found to be on the service line between the house and the Right-of-Way we will do our very best to unblock the problem but a plumber will have to repair the line if necessary. If the problem were found to be internal then a plumber would have to be called for repairs. If there is a sewer like smell in the area that you live in we will document the complaint on a work order and will be looked into as quickly as possible. Sewer smell complaints are the hardest to detect the source of the problem so we ask for patience for us to locate and correct the problem.
The City operates and maintains an extensive sanitary sewage collection system with many miles of underground pipes and pump stations. The sewage is transported to our Waste Water Treatment Plant, where all solids are removed. The water is then disinfected and returned to White Water Creek.
